ORDINANCE 197B
AN ORDINANCE OF THE CITY OF COMBINE, TEXAS, PROHIBITING BURNING OF
TRASH, GARBAGE, BRUSH OR OTHER REFUSE WITHIN THE CITY LIMITS OF
COMBINE AFTER DARK OR DURING PERIODS WHEN KAUFMAN COUNTY HAS
ISSUED A BAN ON OUTDOOR BURNING AND PROVIDING PENALTIES.
WHEREAS, in order to protect the public health, safety and welfare of its citizens, there exists a
need to regulate and prohibit outdoor burning of trash, garbage, brush or other refuse during periods
when burning these items may pose a risk of fire to citizens, dwellings, property, livestock, and
other structures within the City.
NOW, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COMBINE,
TEXAS, THE FOLLOWING:
I. Issuance - Whenever Kaufman County issues a ban on outdoor burning, the City of
Combine will implement and enforce a ban on outdoor burning within the corporate limits
of the City of Combine, including all parts of the City in Dallas County. The ban on outdoor
burning will remain in effect for the duration of the ban imposed by Kaufman County.
Outdoor burning after dark is never allowed.
II. Exemptions - Any exemptions to this ordinance will be those permitted by the Combine
Fire Marshal or the Chief (or assistant Chief) of the Combine Voluntary Fire Department.
Small amounts of non-toxic household trash may be burned during the outdoor burning ban,
during daylight hours, in an enclosed container (example a burn barrel with a screen wire
over the top) provided there is a water hose with water at the fire and the person doing the
burning remains at the fire until it is out and wet down.
III. Enforcement Authority - The Combine Fire Marshal or any Peace Officer of the Combine
Police Department has the authority to enforce this ordinance.
IV. Penalties – A person commits an offense if the person knowingly or intentionally violates
this ordinance or a prohibition or restriction established by an order adopted under this
ordinance. Each occurrence is a separate violation. An offense under this ordinance is
punishable by a fine not to exceed two thousand dollars ($2,000).
This ordinance 197B deletes and replaces old ordnance 197 dated November 1, 1999 and 197A
dated August 1, 2005.

The County has subscribed to CodeRED for our ENS and I wanted to let you know that the CodeRED
system has a Weather Warning feature that people must subscribe to in order to get the severe weather
alert phone calls and that they must subscribe to the ENS if they have a non-published phone number or
only use cell phones. If you will let your residents/employees/members know to do this and have them
pass it along to their friends/family that live in Kaufman County, we can use this as an excellent tool for
severe weather notification since we do not have warning sirens. They will need to go to the County
website at kaufmancounty.net then click on “weather warning” under the CodeRED icon at the bottom left
hand corner of the home page. That will take them to the CodeRED subscriber page and they can simply
fill out the info that is required.
